Hiring in Germany in 2026: the complete guide for international companies

Hiring in Germany as an international company in 2026: employment law, salary norms, works councils, recruiting compliance, and top ATSes.

    Guide — Hiring in Germany

    Hiring in Germany in 2026:
the complete guide for international companies

Germany is the EU's largest economy, the strongest engineering talent pool in Europe, and home to industry-defining tech (SAP, Bosch, Siemens) alongside a thriving startup scene. It's also the EU country where employment law most protects workers — works councils, mandatory consultations, strict termination rules. Here's what international companies need to know to hire in Germany in 2026.

    Why hire in Germany

Three reasons international companies hire in Germany in 2026:

    1. Engineering and technical talent

Germany graduates ~85,000 STEM students/year. Strong technical universities (TUM, RWTH Aachen, KIT, TU Berlin). Concentrations: Berlin (software, AI), Munich (deep tech, automotive), Hamburg (logistics, media), Stuttgart (mechanical, automotive), Frankfurt (fintech), Cologne (gaming).

    2. Stability and quality

German engineering culture values long tenure, quality, and craftsmanship. Senior engineers stay 5-10 years vs 2-3 in US/UK. Employee NPS scores typically higher than EU average.

    3. EU passport

German entities serve as the natural base for EU expansion. Pan-European talent pool accessible via German employment contracts.

    German employment contracts

    Contract types

    • Unbefristeter Arbeitsvertrag — permanent contract. Default. Strong employment protection.
    • Befristeter Arbeitsvertrag — fixed-term. Maximum 24 months without justification (with new hires); up to 48 months in startups (first 4 years).
    • Werkstudent — student work, max 20 hours/week during semester.
    • Mini-Job (450€-Job, now 538€ as of 2024) — low-income marginal employment, tax-favorable.
    • Freier Mitarbeiter — freelancer. Heavily regulated to prevent Scheinselbständigkeit (false self-employment).

    Probation period (Probezeit)

Maximum 6 months. During probation, both parties can terminate with 2 weeks notice. After probation, German termination protection (Kündigungsschutzgesetz) applies — much stricter.

    Compensation structure

    Salary norms 2026

Indicative gross annual salaries for tech roles (Berlin/Munich):

    • Junior software engineer: €55-70k
    • Mid-level engineer: €70-95k
    • Senior engineer: €90-130k
    • Staff/Principal engineer: €130-200k
    • Engineering Director: €160-250k+

Lower-cost regions (Leipzig, Dortmund, smaller cities) typically 15-25% below Berlin/Munich.

    Social contributions

Employer + employee split. Total ~40% of gross salary, split roughly 50/50:

    • Pension (Rentenversicherung): 18.6% (split)
    • Health insurance (Krankenversicherung): ~15% (split)
    • Unemployment (Arbeitslosenversicherung): 2.6% (split)
    • Long-term care (Pflegeversicherung): 3.4% (split)
    • Accident insurance (Unfallversicherung): employer-only

For €80k gross salary: employer cost ~€96k including contributions.

    13th salary and bonuses

Less common than Italy. Christmas bonus (Weihnachtsgeld) and vacation bonus (Urlaubsgeld) are negotiable, not mandatory. Some industries (manufacturing, finance) include them by collective agreement.

Works councils (Betriebsrat) — the wildcard

The most unique part of German employment law. Once a company reaches 5 employees, workers have the right to elect a Betriebsrat (works council). Many international companies are surprised by what triggers and what it grants:

    What the Betriebsrat does

    • Must be consulted on hiring/firing decisions
    • Co-determines working hours, vacation scheduling, performance management
    • Must approve major changes (layoffs, restructuring, new tech that monitors workers)
    • Can veto specific hires for procedural reasons

    Implications for AI in recruiting

Critical point most US-led articles miss: introducing AI screening or AI sourcing into a German workplace with a Betriebsrat requires Betriebsrat consultation under Section 87 of the Works Constitution Act (BetrVG). The Betriebsrat can require:

    • Information about the AI system's capabilities and limitations
    • Documented bias-audit results
    • Explicit workplace agreement (Betriebsvereinbarung) governing AI use
    • Opt-out options for individual employees

tenperzent's compliance pack includes a Betriebsvereinbarung template for AI recruiting; most US-led tools don't.

    The 2026 compliance landscape

    EU AI Act (German implementation)

Same EU regulation, German enforcement via BfDI (Federal Commissioner for Data Protection) + state DPAs. Particularly strict on workplace AI given the Betriebsrat framework.

    EU Pay Transparency Directive

German transposition deadline: 7 June 2026. Adds: mandatory salary range in job ads, pay gap reporting for companies >100 employees, right to pay information.

    BDSG + GDPR

Bundesdatenschutzgesetz (federal data protection) + GDPR. Stricter than EU minimums in workplace context. Notable: employee data has special protections under Section 26 BDSG.

    Allgemeines Gleichbehandlungsgesetz (AGG)

Germany's anti-discrimination law. Prohibits discrimination in hiring on basis of race, ethnicity, gender, religion, disability, age, sexual orientation. Bias-audit documentation is your defense if a candidate alleges discrimination.

    Frequently asked questions

How much does it cost to hire an employee in Germany?

Gross salary + ~20% employer contributions (employee pays the other half). For €80k gross: employer cost ~€96k. Add accident insurance, severance accruals, benefits: ~€100-105k all-in for a €80k role.

How long does it take to hire in Germany?

If you have a German entity (GmbH): 2-6 weeks. If you don't: 3-6 months entity setup, or use an EoR (Deel, Remote) for 1-2 weeks. EoR cheaper to start, direct hire cheaper long-term.

What is a Betriebsrat and does it affect my company?

Works council — elected employee representation triggered at 5+ employees if workers initiate. Must be consulted on hiring/firing, working conditions, and new technology (including AI). Required to negotiate Betriebsvereinbarung for AI recruiting deployment.

Do I need to disclose salary in German job ads?

Not yet (Q2 2026), but yes from June 7, 2026 — EU Pay Transparency Directive transposition deadline. Best practice now: disclose anyway. tenperzent automates salary band publication.

Can I use AI screening for German candidates?

Yes, with significant compliance setup: GDPR + BDSG Section 26 (employee data), AGG bias documentation, Betriebsrat consultation if 5+ employees, EU AI Act Article 11-26 + FRIA from August 2026. tenperzent provides templates; most US-led tools require custom legal work.

What's the typical probation period in Germany?

Maximum 6 months by law. During probation, 2-week notice on either side. After probation, Kündigungsschutzgesetz (employment protection) makes terminations much harder — typically requires social justification or severance.

Is remote-first hiring common in Germany?

Yes — accelerated post-pandemic. Most engineering roles are hybrid or remote. Pitfalls: tax residency if employee moves abroad, mandatory workplace insurance (Berufsgenossenschaft) on home offices, working-time tracking (German labor law requires documented hours).

What ATS works best for German recruiting?

For Germany-specific (Betriebsvereinbarung templates, BDSG compliance, German UI, AGG bias docs): tenperzent. For broader EU + German support: Personio (German company), SmartRecruiters. For US-led companies: Greenhouse + significant manual compliance work.
